1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", or "user") and StayViz Ltd ("StayViz", "we", "us", or "our"), a company registered in England and Wales. By accessing or using the StayViz website, mobile applications, or any associated services (collectively, the "Platform"), you agree to be bound by these Terms in their entirety.

If you do not agree to these Terms, you must not access or use the Platform. We reserve the right to modify these Terms at any time. Material changes will be communicated via the Platform or by email. Your continued use of the Platform following any modifications constitutes acceptance of the updated Terms.

2. Account Terms

Certain features of the Platform may require you to create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information to keep it accurate and complete
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorised use of your account

You must be at least 18 years of age to create an account and use our booking services. We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used for fraudulent purposes.

3. Booking Terms

StayViz acts as an intermediary platform that facilitates hotel bookings between you and accommodation providers ("Hotel Partners"). When you make a booking through the Platform:

  • Your booking constitutes a direct contractual relationship between you and the Hotel Partner
  • The Hotel Partner is responsible for delivering the accommodation and services described in the listing
  • You are responsible for ensuring that all guest details, dates, and room preferences are accurate at the time of booking
  • Booking confirmation is subject to availability and acceptance by the Hotel Partner
  • Special requests (e.g., room preferences, early check-in) are forwarded to the Hotel Partner but cannot be guaranteed

We make every effort to ensure that hotel information, photographs, and descriptions displayed on the Platform are accurate and up to date. However, this information is provided by Hotel Partners and third-party sources, and we cannot guarantee its completeness or accuracy at all times.

4. Pricing and Payments

All prices displayed on the Platform are sourced in real time from Hotel Partners and online travel agencies. Prices are inclusive of applicable taxes unless otherwise stated. You should review the full price breakdown, including any applicable taxes, fees, and surcharges, before confirming your booking.

  • Prices are displayed in the currency indicated on the booking page. Currency conversions are approximate and your bank may apply a different exchange rate
  • Prices may change at any time prior to booking confirmation. The price is locked only upon successful completion of the booking process
  • Payment is processed securely through our authorised payment providers. We do not store your full payment card details on our servers
  • Depending on the rate and Hotel Partner, payment may be collected at the time of booking or at the property upon check-in
  • Some Hotel Partners may place a pre-authorisation hold on your payment card prior to your stay

5. Cancellations and Modifications

Cancellation and modification policies vary by Hotel Partner and rate type. The applicable policy is clearly displayed during the booking process and included in your booking confirmation. It is your responsibility to review these terms before completing your booking.

  • Free cancellation rates: May be cancelled without charge up to the deadline specified in your booking confirmation. Cancellations after the deadline may incur charges as stated in the policy.
  • Non-refundable rates: Cannot be cancelled or modified once confirmed. The full booking amount is charged at the time of booking and is not refundable under any circumstances.
  • No-shows: Failure to arrive at the property without prior cancellation will be treated as a no-show, and you may be charged the full booking amount.

To request a cancellation or modification, please refer to your booking confirmation email or contact our support team. We will process your request in accordance with the Hotel Partner's applicable policy.

6. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, software, and the design, selection, and arrangement thereof, is the property of StayViz or its content suppliers and is protected by United Kingdom and international intellectual property laws.

  • You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Platform without our prior written consent
  • The StayViz name, logo, and all related marks are trademarks of StayViz Ltd. You may not use these marks without our prior written permission
  • User-generated content (reviews, photos) remains your property, but you grant us a worldwide, non-exclusive, royalty-free licence to use, display, and distribute such content on the Platform and in marketing materials
  • If you believe any content on the Platform infringes your intellectual property rights, please contact us with details of the alleged infringement

7. Limitation of Liability

To the fullest extent permitted by applicable law:

  • The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Platform's availability, accuracy, reliability, or fitness for a particular purpose.
  • StayViz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or goodwill.
  • Our total aggregate liability for any claims arising under or in connection with these Terms shall not exceed the total amount you have paid to StayViz in the twelve (12) months preceding the claim.
  • We are not liable for the acts, omissions, or defaults of Hotel Partners, including but not limited to the quality of accommodation, overbooking, or failure to honour a reservation.
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

8. Prohibited Use

You agree not to use the Platform for any unlawful purpose or in any manner that could damage, disable, or impair the Platform. Specifically, you shall not:

  • Use automated systems, bots, scrapers, or similar tools to access the Platform without our written permission
  • Attempt to gain unauthorised access to any portion of the Platform, other user accounts, or our systems
  • Submit false or misleading booking information, reviews, or other content
  • Use the Platform to transmit malware, spam, or other harmful content
  • Resell, sublicense, or commercially exploit any content or services obtained through the Platform

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before initiating formal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation. If a dispute cannot be resolved informally within thirty (30) days, either party may commence legal proceedings.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
